On January 20, 2008, I was seized for a third time at a Southern Arizona internal suspicionless homeland security checkpoint.
This checkpoint has been in operation for at least two weeks at a location over 40 miles North of the Southern border along SR86 in Southern Arizona

Seizing individuals …
Seizing individuals inside the country absent suspicion to interrogate them regarding their citizenship status is actually outside his lawful authority.
Regardless, it wasn’t a DHS or BP policymaker who seized me along a public highway no where near the border absent suspicion.
BTW, it’s interesting that you classify someone peacefully exercising their individual rights at a suspicionless checkpoint as giving an agent a hard time.
Are you against individuals exercising their rights?

He was asking you for identification to verify that you were a United States citizen and that is completely within his authority under the law. Seems to me that you just need something to rant about, so why not DHS or BP. If you have an issue with their policies, take it to the people that make them. He was doing his job as dictated by DHS. You were just giving someone a hard time who didnt deserve it, Give that hard time to his superiors.

You failed to address the larger issue however. In order to “ask” people their citizenship, is it also reasonable to stop, seize, interrogate and search them absent suspicion just because they happen to be within 100 air miles of the border?

You might want to review your history Kev62nesl. In so doing, you may learn that one of the issues leading to the revolutionary war was the use of general warrants or Writs of Assistance by crown agents authorizing them to stop, seize, interrogate and demand the compliance of any colonist so ordered with or without any level of suspicion.
What do you think the genesis of the 4th amendment was anyway?

I was talking about the constitution not the Supreme Court its interpretation. The Supreme Court has been wrong so many times that one cannot list them all. Think Dredd Scott. Plessy v Ferguson. The founders would find you ridiculous.

No one has any obligation to identify themselves to a law enforcement officer when there’s no reason to believe that individual has done anything wrong.
Even the Supreme Court has ruled BP agents have no authority to compel an individual to show ID at this type of checkpoint.
Talk about perverting the 4th. Get a clue Kev62nesl.

The constitution actually reads unreasonable search and seizures. Hey are you a citizen? The founder of the country would laugh at you. How about you go defend my right to not have my country invade by people from other countries? How about you go defend the 2nd amendment? How about you go defend my freedom of speech?

It’s always interesting ‘debating’ this issue with folks like you USSpecOps93. I provide you with quotes from the U.S. Supreme Court regarding the limits of your lawful authority at such checkpoints & you respond with some comment about how you’d abuse your discretion to punish someone who doesn’t answer your questions.
Do you have any clue what the courts have said about checkpoints? Does your department have checkpoint guidelines? Do you even care about the limits of your lawful authority?

Actually, a court of law ultimately decides what constitutes a ‘short time’. A court of law also decides whether or not you had the necessary probable cause to ‘deliver’ a blood test, breath test or any other DUI test.
Given your responses here however, it’s clear you routinely engage in illegal enforcement activity under color of law by purposefully violating people’s rights. I appreciate you being so open regarding your disregard for the rights of others. It makes my job that much easier.

Yea we are investigating DUI, so we can test you all we want, and if we happen to notice a vehicle violation, and you are being an asshole, you are going to receive a citation for it. Where as if you just answered the 2 simple questions you would be on your way.
